These terms of use (“Terms of Use”) apply to services provided by Podspace AB, corporate ID 556991-4046, through the website https://pod.space or https://podspace.com, (the “Site” or “Podspace”).

1. Conditions for Use

All use of the Podspace services is subject to the User accepting these Terms of Use, which the User also confirms when creating a user account. Consequently, upon the acceptance of the Terms of Use the User is granted a non-exclusive and non-transferable right to access and use the Service (as defined below) in accordance with what is set out below.

User can stop using the service at any time and unsubscribe the account. The Terms of Use apply for as long as is the User has an active user account.

2. The Service

Podspace provides its users with hosting, storage and distribution of audio media (“Podcasts”) in accordance with terms and price as set out in the Agreement (the ”Service”). Podspace helps individual creators and major production companies to distribute podcasts to listeners. In doing so, Podspace supports the large platforms that the majority of listeners choose when they consume podcasts; for example, Apple Podcasts, Spotify, Google Podcasts and more.

Podspace also provides statistics and listening data to the User based on its listeners behavior and listening frequency.

3. Use of the Service

User is responsible for all use of the Service and for User login information to be protected from unauthorized access. User is not allowed to transfer or allow someone else to use the User’s account.

User warrants that User shall not use the Service for any purpose that violates applicable laws, government regulations or otherwise may cause harm or inconvenience to Podspace or any third parties.

User is solely responsible for the User Content (see definition below) that User makes available via the Site. User acknowledges and agrees that Podspace is only acting as a passive conduit for User’s online distribution and publication of User Content.

4. User Content

User may provide audio, text, images, logos, videos and/or other material, including third party content (“User Content”) and share this using the Site.

The User Content belongs to the User (or to the relevant third parties). However, Podspace is hereby granted a worldwide, transferable and non-exclusive license to process, distribute and publish information and User Content that is provided through the Site, without any further consent, notice and/or compensation to the User or others. Such disposal for Podspace is only permitted in order for Podspace to fulfill its obligations under the Terms of Use, see Podspace obligations in “Service'' p. 2. All other uses of User Content must be approved by User.

Other users may also, in certain circumstances, access and share your User Content and information, via the Site, social media, email, and otherwise.

Podspace is not responsible for any public display or misuse of User Content. Podspace does not, and cannot, pre-screen or monitor all User Content. However, at discretion, Podspace, or technology Podspace use, may monitor and/or record User interactions with the Site.

If User wishes that Podspace removes User Content from the Site, User sends an email to: [email protected] and Podspace will do so within ten business days of receiving Users request.

5. Right to Monitor User Content

Although Podspace is not obligated to monitor the use of the Site or to review or edit any User Content, Podspace has the right to do so for the purpose of operating the Site, to ensure compliance with these Terms of Use, and to comply with applicable law or other legal requirements. Podspace reserve the right, but are not obligated, to remove or disable access to the Site or any User Content, at any time and without notice, including, but not limited to, if Podspace, at Podspace sole discretion, consider any Content to be objectionable or in violation of these Terms of Use.

Podspace has the right to investigate violations of these Terms of Use or conduct that affects the Services. Podspace may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.
